2. Mortgage Broker Disclosure
We Are a Mortgage Broker, Not a Direct Lender
A Good Lender is a mortgage broker. We do not lend money directly. Instead, we:
- Work with multiple lenders to find loan products that meet your needs
- Submit your loan application to appropriate lenders
- Assist you throughout the loan process
- Facilitate communication between you and the lender
Compensation Disclosure
How We Are Compensated:

Loan Estimate
Within 3 business days of receiving your completed loan application, you will receive a Loan Estimate that includes:

- Estimated monthly payment

Closing Disclosure
At least 3 business days before closing, you will receive a Closing Disclosure with final loan terms and closing costs. Review it carefully and compare it to your Loan Estimate.
5. Truth in Lending Act (TILA) Disclosure
Under the Truth in Lending Act, you have the right to know:
- Annual Percentage Rate (APR): The cost of your credit as a yearly rate
- Finance Charge: The dollar amount the credit will cost you
- Amount Financed: The amount of credit provided to you
- Total of Payments: The amount you will have paid after making all scheduled payments
- Payment Schedule: The number, amount, and due dates of payments
Right to Rescind
For certain refinance transactions on your primary residence, you have the right to cancel the loan within 3 business days of closing without penalty.
6. Real Estate Settlement Procedures Act (RESPA)
Section 8 - Anti-Kickback Provision
RESPA prohibits:
- Kickbacks or unearned fees in connection with real estate settlement services
- Fee splitting arrangements that do not reflect actual services rendered
- Giving or receiving anything of value in exchange for referrals
Affiliated Business Arrangements
If we refer you to a business in which we have an ownership interest or business relationship, we will provide you with an Affiliated Business Arrangement Disclosure as required by RESPA.
Your Rights Under RESPA
You have the right to:
- Shop for settlement services
- Receive a Loan Estimate within 3 business days of application
- Receive a Closing Disclosure at least 3 business days before closing
- Request a list of service providers
- Not be required to use any particular provider
7. Fair Credit Reporting Act (FCRA) Disclosure
Credit Report Authorization
Before obtaining your credit report, we must have your written authorization. By signing a loan application or credit authorization form, you consent to us obtaining credit reports about you from consumer reporting agencies.
Your Rights Under FCRA
- You have the right to obtain a free credit report annually from each credit bureau at www.annualcreditreport.com
- You have the right to dispute inaccurate or incomplete information
- Credit bureaus must investigate disputes within 30 days
- You have the right to place a fraud alert or credit freeze on your credit file
Adverse Action Notice
If we take adverse action (such as denying your loan application) based on information in your credit report, we will provide you with:
- The name, address, and phone number of the credit bureau
- A statement that the credit bureau did not make the decision
- Notice of your right to obtain a free copy of your credit report within 60 days
- Notice of your right to dispute inaccurate information

9. Home Mortgage Disclosure Act (HMDA)
Federal law requires us to collect demographic information (race, ethnicity, sex, age) to help government agencies identify potential discriminatory lending patterns.

12. Appraisal Independence
Dodd-Frank Appraisal Independence Requirements
Federal law prohibits mortgage brokers, lenders, and their employees from influencing or attempting to influence the development, reporting, result, or review of an appraisal through:
- Coercion, extortion, or intimidation
- Compensation, inducement, or bribery
- Instruction or collusion
- Any other manner that would compromise the independence or integrity of the appraisal
Our Appraisal Independence Policies
To ensure appraisal independence and protect you, we maintain strict policies including:
- Separation of Functions: Appraisal ordering is separated from loan production staff
- No Direct Contact: Loan officers are prohibited from directly contacting appraisers
- Firewall Procedures: Information barriers between appraisal management and loan origination
- Training: All staff receive training on appraisal independence requirements
- Monitoring: Regular compliance monitoring and audits
Your Appraisal Rights
- Right to Receive Copy: You have the right to receive a copy of any appraisal report used in connection with your loan application

13. Military Lending Act (MLA) Disclosure
Protections for Active Duty Military
If you are a "covered borrower" under the Military Lending Act (MLA), you are entitled to important protections and disclosures.
Who is a "Covered Borrower"?
You are a covered borrower if you are:
- A member of the Armed Forces on active duty
- A member of the National Guard or Reserves on active duty (not including training)
- A dependent of an active duty service member (spouse or child)
MLA Protections
Under the MLA, covered borrowers are entitled to:
- Interest Rate Cap: The Military Annual Percentage Rate (MAPR) cannot exceed 36% for covered loans
- Fee Restrictions: Certain fees cannot be charged (credit insurance, fees for ancillary products)
- Mandatory Arbitration: Lenders cannot require mandatory arbitration agreements
- Prepayment Penalties: No prepayment penalties are allowed
- Clear Disclosures: Right to receive clear information about loan terms and MAPR
Important Information About MLA Coverage
Note: The MLA does NOT apply to all mortgage transactions. Specifically:
- Purchase Loans: Residential mortgage loans to purchase a dwelling are generally NOT covered by MLA
- Covered Transactions: MLA typically applies to:
- Refinance loans (that are not purchase-money loans)
- Home Equity Lines of Credit (HELOCs)
- Certain personal loans
- Credit cards
How to Determine MLA Status
To determine if you are a covered borrower, we will:
- Ask if you are an active duty service member or dependent
- Verify your status through the Department of Defense's MLA Database
- Provide required MLA disclosures if you are a covered borrower
Your MLA Rights and Disclosures
If you are a covered borrower on a covered transaction, we will provide you with:
- Oral Disclosure: Before or at the time you become obligated on the transaction
- Written Disclosure: A description of the payment obligation and the MAPR
- Clear Statement: A statement that federal law provides important protections to active duty military and their dependents
